Use and Consent:
Please carefully read and understand these Terms of Use before using https://www.empoweredartists.co/ and its associated websites, subdomains, mobile versions, and applications, as well as our programs, including but not limited to our materials, videos, podcasts, courses, masterclasses, events, content, guides, hand-outs, emails, posts, products, and services (collectively “Websites, Programs, and Materials”). The Websites, Programs, and Materials and all related assets are owned, operated, and maintained by the representatives of the Empowered Artists (“Empowered Artists”, “Company,” “we,” “us” or “our”). By accessing our Websites, Programs, and Materials, you acknowledge and agree to be bound by the following Terms of Use. The term “you” refers to any purchaser and/or user of the Websites, Programs, and Materials.
We reserve the right to change these Terms of Use at any time, and the updated version will be effective immediately upon posting. It is your responsibility to review these terms periodically for changes. Your continued use of the Websites, Programs, and Materials following any modifications constitutes your acceptance of the updated Terms of Use.
By using the Websites, Programs, and Materials, you agree to be bound by these Terms of Use as they appear. Whether or not you have read them, you are legally bound by these terms. If you do not agree with these Terms of Use, please refrain from using our Websites, Programs, and Materials.
Age Restriction:
You must be at least 18 (eighteen) years of age to use our Websites, Programs, and Materials. By accessing or using Websites, Programs, and Materials, you affirm that you meet this age requirement.
By purchasing access to our Websites, Programs, and Materials, you explicitly represent and warrant that you are at least 18 years of age and have the legal capacity to enter into this Agreement. You acknowledge that you have read, understood, and agreed to the terms outlined in this Agreement.
We assume no responsibility or liability for any misrepresentation of your age. It is your sole responsibility to ensure that you meet the age requirement specified in this clause. If you do not meet the age requirement, please refrain from using our Websites, Programs, and Materials.
We reserve the right to take appropriate measures to verify your age and may request additional information to ensure compliance with this Age Restriction clause. Failure to provide satisfactory proof of age may result in the termination of your access to our Websites, Programs, and Materials.
If you are under the age of 18, you may only use our Websites, Programs, and Materials with the express consent and supervision of a parent or legal guardian. In such cases, the parent or legal guardian is responsible for complying with this Agreement on behalf of the minor.
You agree to comply with all applicable laws and regulations regarding age restrictions and access to online content in your jurisdiction. If local laws impose a higher age requirement, you must adhere to the stricter requirement.
Billing:
By accessing and using our Websites, Programs, and Materials, you agree to pay all the specified fees associated with the purchase of the access to the Websites, Programs, and Materials, if applicable.
Fees are subject to change, and you will be notified in advance of any changes to ensure transparency.
You agree to provide accurate, current, and complete billing information. It is your responsibility to promptly update your billing information to ensure uninterrupted access to the Websites, Programs, and Materials that you have paid for.
Payments are accepted through the designated payment methods specified on our Websites. You authorize us to charge your chosen payment method for all fees incurred. Our accepted payment methods are credit or debit card.
For subscription-based services, your subscription will automatically renew unless canceled in accordance with the cancellation policy specified on our platform. You are responsible for canceling your subscription before the renewal date to avoid charges for the subsequent billing cycle.
Refunds, if applicable, are subject to the terms of our Refund Policy, which can be found on our Website. It is your responsibility to review and understand our Refund Policy before making a purchase.
In the event of overdue payments, we reserve the right to suspend or terminate your access to our paid Services until payment is received.
Intellectual Property Rights:
The Empowered Artists Websites, Programs, and Materials, and all associated content are the exclusive property of Empowered Artists ("Company," "we," or “us") and are protected by copyright, trademark, and other intellectual property laws.
You are expressly prohibited from:

Selling, reselling, licensing, or otherwise commercially exploiting our Websites, Programs, and Materials.

Reprinting or republishing our Websites, Programs, and Materials for resale.
You may share excerpts of our Materials for non-commercial purposes, provided that proper attribution to Empowered Artists is maintained. Any such use must comply with applicable copyright and intellectual property laws.
You may not modify, adapt, or create derivative works based on our Websites, Programs, and Materials without permission.
We reserve the right to enforce our intellectual property rights to the fullest extent permitted by law. Unauthorized use of our Websites, Programs, and Materials may result in legal action, including but not limited to injunctive relief, damages, and attorney's fees.
If you become aware of any unauthorized use or distribution of our Websites, Programs, and Materials, please promptly notify us at tamara.hergert@empoweredartists.co.
Customer Support
We strive for a respectful and professional interaction with its customers. Any form of disrespectful or aggressive behavior towards our representatives, including through emails, comments, phone calls, chat services, or other means, will result in the immediate termination of the customer's account, regardless of any other provisions in this agreement.
Such violation of this section, or any other provision in this Agreement, will also render the customer ineligible for any refunds.
Termination Clause:
You may terminate these Terms of Use at any time by discontinuing the use of our Websites, Programs, and Materials. Termination by the user does not relieve the user of any outstanding payment obligations incurred prior to the termination.
Empowered Artists reserves the right to terminate these Terms of Use, suspend, or terminate your access to our Websites, Programs, and Materials, with or without cause. In the event of termination by Empowered Artists due to a violation of these Terms of Use, you remain responsible for any outstanding fees and obligations incurred prior to the termination.
Upon termination, your access to our Websites, Programs, and Materials will be immediately discontinued. Any rights and licenses granted to you under these Terms of Use will cease immediately upon termination.
In the event of termination by the user or Empowered Artists, our Refund Policy, as outlined on our Website, will dictate the eligibility and process for any applicable refunds.
The clauses related to Intellectual Property Rights, Indemnification, Limitation of Liability, Release of Claims, Applicable Law, Billing, and any other provisions necessary for the interpretation and enforcement of these Terms of Use will survive termination.
Termination of these Terms of Use does not absolve you of any outstanding obligations, including but not limited to payment obligations and compliance with confidentiality and Intellectual Property Rights provisions.
In the event of termination, Empowered Artists may provide notice via email or other means of communication as deemed appropriate.
Empowered Artists reserves the right to modify, suspend, or terminate any aspect of our Websites, Programs, and Materials at any time without prior notice.
Indemnification:
You agree to defend, indemnify, and hold Empowered Artists harmless from any claims, damages, liabilities, costs, and expenses, including legal fees and expenses, arising out of or related to your use of our Websites, Programs, and Materials.
This indemnification extends to our affiliates, agents, contractors, officers, directors, shareholders, employees, joint venture partners, successors, transferees, assignees, and licensees, as applicable.
Your obligation to indemnify arises from your use of our Websites, Programs, and Materials, and any breach of these Terms of Use or any other agreement with us.
Limitation of Liability:
We will not be held responsible or liable in any way for the accuracy, completeness, or suitability of the information, products, or materials obtained through our Websites, Programs, and Materials.
We disclaim any liability for any direct, indirect, special, incidental, equitable, or consequential damages resulting from your use or reliance on our Websites, Programs, and Materials.
We do not assume liability for accidents, delays, injuries, harm, loss, damage, death, lost profits, personal or business interruptions, misapplication of information, physical or mental disease or condition, or any other loss or difficulty, arising from any act or default of anyone affiliated with us.
Release of Claims:
In no event will we be liable to you or any party for any type of direct or indirect damages resulting from your use of or reliance on our Websites, Programs, and Materials.
You release us from any and all claims, including but not limited to those related to lost profits, personal injuries, accidents, misapplication of information, or any other loss, physical or mental disease or condition, or issue, arising from using our Websites, Programs, and Materials.
You expressly waive any claims or demands against us, even if we are expressly advised of the possibility of such damages or difficulties.

Empowered Artists does not hold itself out as an accredited school and provides no educational credits, nor does it confer any state-authorized degrees or certificates.
Applicable Law:
These Terms of Use are governed by and construed in accordance with the laws of the state of Washington. Any dispute, claim, or legal matter arising under or in connection with these Terms of Use shall be subject to the exclusive jurisdiction of the courts of the state of Washington.
By using, accessing and/or purchasing any of our Websites, Programs, and Materials, you agree to resolve disputes through arbitration on an individual basis, waiving certain legal rights.
Some jurisdictions may not permit certain disclaimers, limitations, or exclusions. If you reside in such a jurisdiction, some or all of the disclaimers, limitations, or exclusions outlined in these Terms of Use may not apply to you, and you may have additional rights.
Regardless of your location, the specified governing law applies to all users of our Websites, Programs, and Materials.
Users are responsible for ensuring their compliance with applicable local laws and regulations. Policies
Privacy Policy
The Empowered Artists takes very seriously the responsibility of maintaining the privacy of our members, event attendees, and event faculty and speakers. It is our policy not to share or sell personal information (first name, last name, email address). Communications from the Empowered Artists to its members are limited to information regarding art business best practices, interviews, success mindset, masterclasses, events; educational and job opportunities in the field of art business industry; and related endeavors. If members receive questionable correspondence from someone outside the Empowered Artists or believe their contact information may have been shared with or hacked by an outside entity, please contact us immediately. We will investigate the source and, if necessary, issue an immediate cease and desist order to the offending party.
We do not sell your Personal information.
Non-Solicitation Policy
The Empowered Artists has a very strict policy on the use of any and all member contact information. This includes all names, email addresses, and member activity information. THIS INFORMATION MAY NOT BE USED FOR ANY SOLICITATIONS, ANNOUNCEMENTS, OR OTHER ITEMS OF ANY KIND. Violation of this policy will result in immediate termination of your membership.
Use of the Site by Minors Policy
You must be 18 or older to join the Empowered Artists Community as a Member, take our Masterclasses, and/or attend our Events.
Refund Policy
Due to the digital nature of the materials contained in the community, Membership, Masterclass, and Event fees are non-refundable. All fees paid to Empowered Artists shall be fully earned when paid and shall be non-refundable for any reason whatsoever.
Anti-Harassment Policy
The Empowered Artists is dedicated to providing a safe environment for all of its members and will take any and all necessary steps to address and prevent harassment within the community and at events. Harassment under this policy may include verbal comments, written comments, displayed images, or behaviors such as intimidation, stalking, body policing, unwelcome photography or recording, sustained disruption of talks or other events, inappropriate physical contact at in person events, unwelcome sexual attention or advances, and bullying or coercion.
The Empowered Artists Anti-Harassment Policy applies to all situations of harassment or intimidation within the Empowered Artists Community on Mighty Networks Platform or on Empowered Artists social Media pages or at any Empowered Artists Event. An “Empowered Artists Event” is any event, meeting or activity that is authorized by the Empowered Artists. This Empowered Artists Anti-Harassment Policy applies to “Empowered Artists On-Line Interactions,” which include Crowdcasts, Zooms, Webinars, online meetings, Live broadcasting, communications and content posted on, or directed towards, Empowered Artists’ Social Media accounts or sent through any of the communication tools available on Empowered Artists Community, https://empoweredartists.mn.co/ or website, https://www.empoweredartists.co
Empowered Artists’ Social Media accounts under this policy include the official Empowered Artists’ accounts on Facebook, Instagram, Youtube, Twitter, and other social media platforms.
Code of Conduct
All Empowered Artists Community members and participants of the Empowered Artists Events and Empowered Artists On-Line Interactions, are required to comply with the following code of conduct. The Empowered Artists Anti-Harassment Policy prohibits harassment, including but not limited to the following behaviors on-line or in-person:

Harmful or prejudicial verbal comments, written comments, or visual images related to gender, sexual orientation, ethnicity, race, religion, socio-economic status, disability, age, appearance, body size, or other personal characteristics;

Abusive verbal comments, inappropriate posting of nudity and/or sexual images within the Empowered Artists Community platform or on the Empowered Artists social media pages;
-
Unwelcome attention on-line within the Empowered Artists Community platform;
-
Intimidation, stalking or following, physical assault (including unwelcome touching or groping) at the Empowered Artists in-person events;
-
Real or implied threat of physical harm;
-
Real or implied threat of professional or financial damage or harm;
-
Sustained disruption of talks or other events;
-
Unwelcome sexual attention or advances;
Harassment does not include respectful disagreement or reasonable and respectful exchange of opinions made in good faith.
We expect all Empowered Artists Community members and participants at activities, meetings, and events to abide by this Anti-Harassment Policy in all venues, including sanctioned events, ancillary events, unofficial events, and social gatherings.
Reporting Procedures
Any person who believes there has been a violation of the Empowered Artists Anti-Harassment Policy can report the offense via one of the following ways:

By clicking a “Report” within someone’s profile or comment post within the Empowered Artists community platform.

By sending us an email here. Reports should include the substance of the complaint, date, and whenever possible, a reference to the relevant URLs and screenshots, if the offense occurred through an Empowered Artists On-Line Interaction within the community.
Empowered Artists will investigate all complaints subject to the Anti-Harassment Policy. If the policy applies, Empowered Artists will investigate the matter and take whatever action is necessary and appropriate to prevent a recurrence and protect the environment within the Empowered Artists Community platform and at on-line and in-person events. Empowered Artists will make every attempt to respond to a named complainant in a timely fashion. If appropriate, Empowered Artists may report the incident to local authorities.
Sanctions
Empowered Artists takes all allegations of harassment seriously. Complaints will be investigated by Empowered Artists if they fall within the scope of Empowered Artists’ Anti-Harassment Policy. Depending on the results of the investigation, Empowered Artists will determine whether a sanction is appropriate.
Sanctions for Community Hosts, Community Managers, Speakers or Staff may include any of the following:

warning the party involved that the particular behavior is inappropriate and must be ceased;
-
immediate removal from a particular on-line or in-person event;
-
denial of access to Empowered Artists Community and/or social media accounts, and/or other on-line spaces on a temporary or permanent basis;
-
withholding of a contracted honorarium (for Speakers);
-
termination of employment (for Community Hosts, Community Managers and Staff);
-
prohibition from future engagements with the Empowered Artists;
-
prohibition from future employment at Empowered Artists;
-
expulsion from Empowered Artists Community; and/or
Sanctions for Attendees, Members, and Guests can include any of the following:
-
warning the party involved that specified behavior is inappropriate and must be ceased;
-
immediate removal from the Empowered Artists Community or a particular Masterclass or Event, without refund;
-
denial of access to Empowered Artists Community, Masterclass or Event or spaces and venues on a permanent or temporary basis;
-
termination of Empowered Artists Community membership, without refund; and/or
-
prohibition of future Empowered Artists Community membership.
If the conduct at issue involves one of Empowered Artists' employees, Empowered Artists will utilize whatever corrective action is appropriate based on the result of the investigation and subject to Empowered Artists employment policies and practices.
Confidentiality
Empowered Artists will make every reasonable effort to conduct all investigations into allegations of harassment, intimidation, or discrimination in a manner that will protect the confidentiality of all parties and witnesses. Notwithstanding the above, confidentiality is not absolute, and those with a legitimate business reason to know and be informed of the allegations will be so informed. Parties to the complaint should treat the matter under investigation with discretion and respect the reputation of all parties involved.
