The Website and all related assets are owned and operated by Empowered Artists (“Company,” “we,” or “us”). By accessing the Website or using any of our Memberships, Masterclasses, Events, Programs, Products, and/or Services, you acknowledge and agree to be bound by the following Terms of Use. The term “you” refers to any purchaser and/or user of the Website, Community, Masterclasses, Events or any of our Programs, Products, and/or Services.

We reserve the right to change these Terms of Use at any time, and the updated version will be effective immediately upon posting. It is your responsibility to review these terms periodically for changes. Your continued use of the Website, Community, Masterclasses, Events, Programs, Products, and Services following any modifications constitutes your acceptance of the updated Terms of Use.

By using the Website, joining as a member, or using/purchasing any of our Memberships, Masterclasses, Events, Programs, Products, or Services, you agree to be bound by these Terms of Use as they appear. Whether or not you have read them, you are legally bound by these terms. If you do not agree with these Terms of Use, please refrain from using our Website, Community, Masterclasses, Events, Programs, Products, and Services.​

You must be at least 18 (eighteen) years of age to use our Websites, Community, Masterclasses,  Events or any of our Programs, Products, and/or Services. By accessing, using, or purchasing our Membership, Masterclasses, or any of our Programs, Products, and/or Services, you affirm that you meet this age requirement.

By purchasing our Membership, Masterclasses, Events or any of our Programs, Products, and/or Services, you explicitly represent and warrant that you are at least 18 years of age and have the legal capacity to enter into this Agreement. You acknowledge that you have read, understood, and agreed to the terms outlined in this Agreement.

We assume no responsibility or liability for any misrepresentation of your age. It is your sole responsibility to ensure that you meet the age requirement specified in this clause. If you do not meet the age requirement, please refrain from using our Websites, Community, Masterclasses, Events, Programs, Products, and/or Services.

We reserve the right to take appropriate measures to verify your age and may request additional information to ensure compliance with this Age Restriction clause. Failure to provide satisfactory proof of age may result in the termination of your access to our Websites, Community, Masterclasses, Events, Programs, Products, and/or Services.

If you are under the age of 18, you may only use our Websites, Community, Masterclasses,  Events, Programs, Products, and/or Services with the express consent and supervision of a parent or legal guardian. In such cases, the parent or legal guardian is responsible for complying with this Agreement on behalf of the minor.

You agree to comply with all applicable laws and regulations regarding age restrictions and access to online content in your jurisdiction. If local laws impose a higher age requirement, you must adhere to the stricter requirement.

By accessing and using our Website, Community, Masterclasses, Events, Programs, Products, and Services, you agree to pay all fees associated with the purchase of Memberships, Masterclasses, Events, Programs, Products, and/or Services as specified on our platform.

Fees are subject to change, and you will be notified in advance of any changes to ensure transparency.

You agree to provide accurate, current, and complete billing information. It is your responsibility to promptly update your billing information to ensure uninterrupted access to our paid Services.

Payments are accepted through the designated payment methods specified on our platform. You authorize us to charge your chosen payment method for all fees incurred. Our accepted payment methods are credit or debit card.

For subscription-based services, your subscription will automatically renew unless canceled in accordance with the cancellation policy specified on our platform. You are responsible for canceling your subscription before the renewal date to avoid charges for the subsequent billing cycle.

Refunds, if applicable, are subject to the terms of our Refund Policy, which can be found on our platform. It is your responsibility to review and understand our Refund Policy before making a purchase.

In the event of overdue payments, we reserve the right to suspend or terminate your access to our paid Services until payment is received.

​Intellectual Property Rights:

The Empowered Artists Website, Community website and platform, and all associated Materials, including but not limited to content, masterclasses, services, guides, hand-outs, and emails (collectively referred to as "Materials") are the exclusive property of Empowered Artists ("Company," "we," or "us"). All content and materials shared with you are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, revocable, non-exclusive, and non-transferable license to download and/or print our Materials for your own personal use in the normal course of your business activities. This license is solely for your benefit and does not grant any rights to third parties.

You are expressly prohibited from:

• Sharing our Materials with third parties.

• Selling, reselling, licensing, or otherwise commercially exploiting our Materials.

• Reprinting or republishing our Materials for resale or mass reproduction purposes for your own business use.

You may share minimal excerpts of our Materials for non-commercial purposes, provided that proper attribution to Empowered Artists is maintained. Any such use must comply with applicable copyright and intellectual property laws.

You may not modify, adapt, or create derivative works based on our Materials. Any unauthorized use, reproduction, or distribution of our Materials constitutes a violation of our intellectual property rights.

We reserve the right to enforce our intellectual property rights to the fullest extent permitted by law. Unauthorized use of our Materials may result in legal action, including but not limited to injunctive relief, damages, and attorney's fees.

If you become aware of any unauthorized use or distribution of our Materials, please promptly notify us at info@empoweredartists.co.

Customer Support

We strive for a respectful and professional interaction with its customers. Any form of disrespectful or aggressive behavior towards our representatives, including through phone calls, emails, chat services, or other means, will result in the immediate termination of the customer's account, regardless of any other provisions in this agreement. 

Such violation of this section, or any other provision in this Agreement, will also render the customer ineligible for any refunds.

Termination Clause:

You may terminate these Terms of Use at any time by discontinuing the use of our Website, Community, Masterclasses, Events, Programs, Products, and/or Services. Termination by the user does not relieve the user of any outstanding payment obligations.

Empowered Artists reserves the right to terminate these Terms of Use, suspend, or terminate your access to our Website, Community, Masterclasses, Events, Programs, Products, and/or Services, with or without cause. In the event of termination by Empowered Artists due to a violation of these Terms of Use, you remain responsible for any outstanding fees and obligations incurred prior to termination.

Upon termination, your access to our Website, Community, Masterclasses, Events, Programs, Products, and/or Services will be immediately discontinued. Any rights and licenses granted to you under these Terms of Use will cease immediately upon termination.

In the event of termination by the user or Empowered Artists, our Refund Policy, as outlined on our platform, will dictate the eligibility and process for any applicable refunds.

The clauses related to Intellectual Property Rights, Indemnification, Limitation of Liability, Release of Claims, Applicable Law, Billing, and any other provisions necessary for the interpretation and enforcement of these Terms of Use will survive termination.

Termination of these Terms of Use does not absolve you of any outstanding obligations, including but not limited to payment obligations and compliance with confidentiality and proprietary rights provisions.

In the event of termination, Empowered Artists may provide notice via email or other means of communication as deemed appropriate.

Empowered Artists reserves the right to modify, suspend, or terminate any aspect of our Website, Community, Masterclasses, Events, Programs, Products, and/or Services at any time without prior notice.

Indemnification:

You agree to defend, indemnify, and hold Empowered Artists  harmless from any claims, damages, liabilities, costs, and expenses, including legal fees and expenses, arising out of or related to your use of our Website, Community, Masterclasses, Events, Programs, Products, and Services.

This indemnification extends to our affiliates, agents, contractors, officers, directors, shareholders, employees, joint venture partners, successors, transferees, assignees, and licensees, as applicable.

Your obligation to indemnify arises from your use of our Website, Community, Masterclasses, Programs, Events, Products, and Services, and any breach of these Terms of Use or any other agreement with us.

 

Limitation of Liability:

We will not be held responsible or liable in any way for the accuracy, completeness, or suitability of the information, products, or materials obtained through our Website, Community, Masterclasses, Events, Programs, Products, and Services.

We disclaim any liability for any direct, indirect, special, incidental, equitable, or consequential damages resulting from your use or reliance on our Website, Community, Masterclasses, Events, Programs, Products, and Services.

We do not assume liability for accidents, delays, injuries, harm, loss, damage, death, lost profits, personal or business interruptions, misapplication of information, physical or mental disease or condition, or any other loss or difficulty, arising from any act or default of anyone affiliated with us.​

Empowered Artists does not hold itself out as an accredited school and provides no educational credits, nor does it confer any state-authorized degrees or certificates.

 By purchasing the Empowered Artists Community Membership, Masterclasses, Programs, Events, Products, and Services, and Program Materials, you acknowledge, accept, and understand that you are fully responsible for your progress and results from your participation.

You recognize that the outcomes achieved are contingent upon your dedication, effort, and commitment to implementing the information provided.

Empowered Artists makes no express or implied representations, warranties, or guarantees, verbally or in writing, of any kind.

This includes but is not limited to representations, warranties, or guarantees regarding fitness, merchantability, or any specific results or outcomes derived from the use of our Community Membership, Masterclasses, Events, Programs, Products, Services, and Program Materials.

Empowered Artists does not provide professional legal, tax, medical, psychological, or financial advice. Any information, guidance, or suggestions provided should not be construed as professional advice, and you should consult with qualified professionals for specific guidance in these areas.

Any statements outlined in our Materials are expressions of our opinion and are not to be construed as guarantees of any kind. Results may vary, and individual success depends on various factors, including personal dedication and circumstances.

These Terms of Use are governed by and construed in accordance with the laws of the state of Washington. Any dispute, claim, or legal matter arising under or in connection with these Terms of Use shall be subject to the exclusive jurisdiction of the courts of the state of Washington.
